1. How do I know if I will qualify for an assigned attorney?

Financial eligibility is determined on a case-by-case basis. The inability to afford legal representation is not synonymous with destitution or a total absence of means. You cannot have an attorney appointed to your case until the case is on the calendar and a first appearance has been made.

2. How do I apply for Assigned Counsel?

To determine eligibility, you must complete a Family Court Eligibility Form, and submit it to the Conflict Defender’s Office either by mail, fax, or email. Please note, your form must be signed. Family Court Eligibility Form

3. What is the Assigned Counsel Program?

The assigned counsel program is run through the Ontario County Conflict Defender’s Office. This office assigns attorneys to indigent individuals for Family Court matters and matters that are a conflict of interest for the Public Defender to handle.
